Migrations constitute an unsolved world problem. A purely educational vision of the subject would be insufficient, it is necessary to consider other issues such as legal stay, work, housing, health, language, cultural and religious exercise, social participation. The situation of the schooling of immigrant students is reviewed from a legal, pedagogical and documentary perspective. There is the right to education for immigrant students but there are difficulties for their school integration such as low curricular performance, the concentration of these students in certain schools, a certain rejection of immigrants, little preparation of teachers to give an adequate response. The schooling process in our country does not present serious problems and it is offered in decent conditions, but there are aspects to improve. As answers to this problem, it is necessary to deepen intercultural and inclusive education as conceived by international organizations, mainly UNESCO.
