Abstract

This study develops a documental analysis about the incorporation of EC 59/2009 by LDBEN 9394/1996 through Law 12,796/2013 with the objective of highlighting the implications of this incorporation for the declaration and realization of the right to education in the context of Early Childhood Education . The study shows that the movement of incorporation of EC 59/2009 by LDBEN 9394/1996 promotes normative and conceptual weaknesses that weaken the declaration and guarantee of the right to education and the very conceptions of basic education and early childhood education (as the first stage of education basic) by: a) inducing a mistaken and linear understanding between age group and stage of basic education, b) by maintaining, contradictorily, the terms "nursery" and "pre-school" in the context of early childhood education, reinforcing a historical split and c) by promoting the duplication of terminology around basic education, making coexist in LDBEN 9394/1996 the terms “basic education” and “compulsory basic education”.
