Considering the gains obtained in the normative aspect of Early Childhood Education in Brazil and Argentina, especially after 1988, this article seeks to present the actions aimed at this education stage, encompassing the educational standardization and its programs, as well as its actions, to understand the initiatives these two countries have been formulating. Our study is supported by documental research using the Brazilian and Argentinian legislation as sources. We verified that both the Early Childhood Education in Brazil and the Initial Education, as it is called in Argentina, have made legal progress in the programs and actions execution. These advances are perceived in the extension of the school places offer, as well as in the conquest of mandatory attendance since pre-school as a way to promote the right and integral development. However, both countries have not taken full responsibility for small children’s education and, even though they have legally recognized them as subjects with rights, the governments are far from concretely fomenting those guarantees to the effectuation of support practices in institutions that meet the existing demand in the two countries.
