Abstract

This article aims to reconstruct the main ideas presented by Günther in his book Der Sinn für Angemessenheit: Anwendungsdiskurse in Moral und Recht. In this book, the philosopher shows that there are two types of discourse, namely, the discourse of justification and the discourse of application. The First part of the universal principle “U” - already known of discourse ethics. Its function is justified by consideration of all the interests involved. For Günther, the mistake of the discourse of justification was to understand the validity of a norm as containing each of its application situations. On the other hand, the discourse of application aims to consider the particularities of the situation in order to determine which norm is most appropriate for the context in question.
