This article has as aim to examine the teacher`s constitution in the higher educa tion according to the principle of the laity. The Brazilian juridical order of education by their laws, rules, finalities and objectives sustains the laity as a component of the teacher´s constitution in all the higher education institutions. This does not mean an anti-religious stance nor the prohibition that the confessional institutions can offer their difference without imposition of values.
