This paper aims to present an overview of the theoretical and normative foundations of Human Rights Education in Higher Education, with special emphasis on the constitutive process of this educational practice in the Brazilian context. To this purpose, the authors sought to understand the context in which HEIs are inserted – especially public universities – as well as the theoretical foundation of HRD present in academic literature and in the main Brazilian instruments and norms. As main results, it is possible to highlight the following: (a) HRD, as a recent educational practice, is linked to the perspective that the social commitment to be assumed by public universities consists in the production of basic research and the formation of critical knowledge; (b) this practice, as an essential part of the set of fundamental rights, aims to prevent violations, to inform and to make known the rights by which we are subjected; (c) in Higher Education, it is established, mainly, in the National Plan for HRD, as well as in the National Guidelines for HRD, constituting an axis of action by which Brazilian universities are required to act.
