This article presents a study to clarify how federal education rules are applied to state systems of education. We wanted to do a study of the competences of Federated Institutions with regard to education and in light of the Educational Law, through systematic analysis, we present a doctrinal position regarding the effectiveness of federal regulations in the educational systems of the States and municipalities, in order to guide managers and educators in decisions about the education standards. It is well known that learning systems, from what determinates the Brazilian Constitution in its article 211, following proposition  republican federative, have autonomy of competences respecting the general national legislation determined by the Law of Guidelines and Bases of National Education (Law 9.394/96) (BRASIL, 1996).
