This paper has its origin in a research titled Black Youth Genocide: from Fanon to Act 10.639/2003. Strategies for creating black identities as a means of resistance (Restinga, Porto Alegre – RS, 2010-2018) and discusses the significant and unequal death rate of the black youth in Brazil. To that extent, we bring forward an exposition of Frantz Fanon theories, such as racism and colonialism, which help us to recognize Brazilian racism, and the condition in which the black youth lives in Brazil. Although Fanon asserts that his arguments only refer to the historical period he writes about and the colonial studies, we believe that it is possible to draw a comparison between his work and Brazil’s present time when it comes to the death of the black youth. We analyzed the three means of violence debated by the author – psychological, structural and physical – in which such people live. Our aim was to reflect upon the creation of black identities in order to understand where and how they are inserted in the Brazilian society. For this purpose, we believe it is necessary to study in which ways Brazilian racism appears and recognize what we call the myth of racial equality (against which we constantly fight), so that through the recognition of such problem we can look for solutions. This paper, then, also approaches the Act 10.639/ 2003 which refers to the compulsory teaching of African culture and Afro-Brazilian culture in schools. We consider this Act an important public policy in the promotion of racial equality through the appreciation of African cultures. We understand that the effective enforcement of such law supports the building of positive black identities, either for black people or for nonblack, and this acknowledgement of identities may work as powerful tools against the significative death rate of black youth in Brazil.
