The study analyzes the normative protection of the right to basic education in the member countries of the Southern Common Market (Mercosur), which are: Argentina, Brazil, Paraguay, Uruguay and Venezuela. To do so, a comparative study was carried out with a bibliographical and documentary research (Constitutions and Legislative Education in force) with a qualitative approach. It is pointed out that the Brazilian, Paraguayan and Venezuelan legal framework shows more specific and forceful elements for the normative guarantee of educational law. The Argentine Constitution, as well as the Uruguayan, is rather laconic about the legal frameworks of the right to education. This framework has shown that there is a consolidation of an educational legal order in the context of Mercosur, but that there is still a lack of regulations to ensure a broader protection of the right to education. In this bias, it is imperative to affirm that due to the scope of the theme, we recognize that there is an extensive field of open research so that one can deepen and produce new knowledge on this subject.
