This essay aims to analyze the effects of the changes made to the National Education Guidelines and Bases Law (LDBEN/1996) to be observed in the organization and management of education in Brazil. The study was supported by documentary research, using as sources the text of LDBEN/1996 and the legal provisions that determined the changes to this Education Law over the 25-year period of its validity (19962021). It initially addresses the principles and purposes of national education to be incorporated into the solidarity duties exercised by the State and the family in realizing the right to education. Then, with methodological support in Content Analysis, the legal provisions that specifically modify titles 3 and 4 of LDBEN/1996, which reference management processes within the scope of education systems and public schools, are analyzed. The conclusions highlight both the LDBEN provisions that are favorable to the march to guarantee the right to education and those that represent a clear setback in relation to this claim. In view of this reality, discernment about what is effectively inferred from the law is advocated, in order to mobilize its progressive contributions in the fight to defend public education in the current situation in the country.
