This article presents as it is theme the citizen deprived of liberty who remains the holder of all fundamental rights not achieved by the sentence or by the law, as established by the Criminal Execution Law (LEP). Except for the right to come and go, and also political rights, the prisoner maintains the rights like any other citizen. Having said that, this article adheres exclusively to the right to education and its consolidation in the legal system and in the social body. The study brings the history of the prison system, the dynamics of power, the evolution of educational legislation dedicated to the convict and the practical obstacles to its implementation. The objective is to understand the prison system and the mechanisms that keep it as we know it, in addition to describing its effectiveness in the prisoner's right to education. The methodology used is based on the literature review, which uses theorists such as: Beccaria (1959), Wacquant (1999) and Foucault (2004), based on academic research carried out between 2013 and 2017, and with the inclusion of other authors. It is concluded that, although there is a legal provision, there are historical, cultural, material and pedagogical obstacles that mean that the detainees do not actually have access to education in a universalized way, as established by the national legislation.
