The present study is intended to show the existence of formalism within the Brazilian Educational System through evidencing the hypothesis that there exists significant discrepancy between the legal dispositions and their implementation at the schools, and that such discrepancy iseven greater within the less urbanized communities and within the public schools. Studies are made of the principal's qualifications, and of the qualifications of the teaching staff, as well as of the technical personnel's conditions, functioning of the school services and of the conditions of the facilities and teaching material in order to test the proposed hypothesis, the validity of which has been confirmed with a high level of probability. The study was performed with samples from secondary schools in the State of Rio Grande do Sul. The article describes the general conditions of the human, technical and material resources as well, which are available to the secondary schools in the State of Rio Grande do Sul.
