This article discusses the main problems related to the definition of the constitutional rights of children between 0 and 6 years of age, to pre-school education and day care, in the new Brazilian Constitution that is going to be voted by the National Congress, begining in February, 1987. It also analyses the existent proposals to this new Constitution - specially the one prepared by a Comission that was coordinated by Afonso Arinos, who was appointed for this task by the late President Trancredo Neves - in the aspects related to the educational rights of small children.
