The growth of cases relating to the practice of bullying in the school environment have generated numerous discussions on liability. So, we will seek to analyze the practices of bullying at school can be fought from the perspective of the protection stemming from fundamental rights, yet anchored in existing court decisions on the subject. As a result, we can say that although educational institutions possess temporary duty to guard and watch over the child or adolescent, this fact can not be considered sufficient to elide constitutionally attributed to the responsibility of parents to educate their children.
