Abstract

The article aims to analyze the relationship between State, citizenship and the right to education through theoretical studies that question the idea of education by setting social rights resulting from the development, by superposition, of citizenship rights . Therefore, we use the "program" denominations as relative to what is declared intentions or goals; and "diagram" as regards the representation of social phenomena. This analytical course concluded that: a) the social rights presuppose the notions of equality and social responsibility, but we cannot therefore say that they came into existence only when the welfare state emerged in the twentieth century; b) the protection and registration of the right to education as a "program" does not mean its consolidation as a "diagram ".
