ABSTRACT: Urgent issues affecting the right to education are discussed in this paper. The text argues that we are facing a new social and racial segregation. These are times that unfold in a tension between affirmation and negation of human rights and reduction of the right to education to a minimum. That is expressed in the affirmative presence of social groups and the control measures and repression of their struggles. How these social and political tensions affect peculiarly the right to education? It is argued that the struggle for the right to education can't avoid its fight against moral criminalization of teenagers and young popular as a justification of social and racial segregation so fashionable today. That is, the denial of rights of adolescents and poor and black youths undergoing criminal justice, deprivation of the right to life and the criminal age relegation threatened has consequences for the guarantee or denial of the right to education. In the contemporary Brazilian context, the struggle for educational justice is linked to the struggle and denunciation of social and racial segregation of our children and youth.
