This article examines the theoretical base of higher education at a distance policy in Brazil in the 1990s and the first decade of the new century. It is based on the understanding that this policy is inscribed in the neoliberal education reforms of this period, conducted in conjunction with the policies developed, promoted and monitored by international agencies. The paper presents the main actions and legislation concerning distance education from 1995 to 2010, and identifies the central focus of these policies - “technological updating” and “expanded access to education” - and their theoretical foundation in the concepts of “economic globalization” and the “information society”, which were promoted by U.S. business schools and international agencies. It analyzes the extent to which distance education, especially higher education at a distance in Brazil, enables wider scale education and deepens the commoditization of education through the expansion of the number of private institutions and distance learning courses. This process is conducted by government policies in the period, guaranteeing profitability to the bourgeoisie for educational services (local and international) through the adaptation of education to the new phase of capital accumulation.
