This article aims to evaluate the performance of Brazilian municipalities regarding the second part of Goal 1 of the Plano Nacional de Educação [National Education Plan] - to expand the supply of childcare centers so that, by the end of its term (2024), at least 50% of the children up to 3 years old are cared for - as well as to relate that performance with the phenomenon of judicialization of the right to early childhood education in the country. The research is socio-legal in nature and uses a qualitative methodology. The conclusion shows that the failure to meet Goal 1 in national terms reveals a persistent regional and socioeconomic inequality in the access to childcare centers. It also shows that judicialization contributes to accelerating the expansion of the supply which is heavily dependent on establishing partnerships with private institutions.
