Abstract

As in other dictatorships in the Southern Cone, during the last Argentine military dictatorship (1976-1983), the women detained were victims of different forms of sexual violence. Only in recent years, after the reopening of trials for crimes against humanity and with a considerable amount of resistance, the official organs began to consider the possibility of judging sexual violence as a crime differentiated from torture. In this paper we intend to give an account of the main legal debates about the possibility of judging these crimes and we will argue in favor of the possibility of such judgment.
