Initially, this article was elaborated to a specific institution interested in knowing and discussing the legal text about the final evaluation of higher education students and its implications. Now adapted it present; in the first section the main articles of the recently enacted Brazilian Law n° 9131/95. A sample of reactions and criticisms to the legal text and to the first National Exam of Courses (occurred in November, 1996), as well as the official answer from representatives of the Ministry of Education are lined up in the following section so the reader may elaborate his/her own critical conclusions. The last section recognizes that evaluation is an essential component for reaching high quality of the professional formation; then suggests a series of actions to be implemented by those courses or institutions which are concerned about academic improvement of undergraduate students and their professional proficiency.
