The article approaches the relations between the Union, States and Counties in the scope and incumbencies of the development of elementary education. It makes a historical briefing, detaching the ma in normative acts that regulate these relations, that, however being minute in the definition of the responsibilities, as it is our legal tradition, couldn't obtain its faithful fulfillment. It's also discussed the increase of tied prescriptions promoted by the Constitution of 1988, its consequence in the budget of the Union and the available resources for education. The article finishes analyzing the Fund of Maintenance and the Development of the Basic Education and the Valuation of the Teaching, more recent assay of attempt in the financing of the basic education. Even introducing transparency in the accounts of education, it is salient that the financial contribution of the Union, once more, is for short from the expected one.
