The regulation of the profession of physical educators contributed to the creation of the federal and regional councils - CONFEF/CREF systems. It is now time to discuss the intervention and training in the three levels of health prevention public policies. There have been two attempts to include physical education into the CONFEF/CREF system. The first concerns the Brazilian classification of occupations - CBO of the Ministry of Labor, already done, and the second is an ongoing process in the official health system - SUS. The goal of this paper is to present an analysis of the insertion of physical education in Brazilian public policies. It is concluded that there is legal background to support the intervention of physical educators in health prevention activities of the second and third levels. The classification of physical education in CBO was a great step forward towards its admission in the official health services.
