The objective of this study is to analyze Law n. 13,415 regarding to the problematic determination of expanding the workload and, also, to the proposal of innovations for the curriculum without making a diagnose for these impactful changes. For the purpose of measuring the consequences of these actions in public schools, the Innovative High School Program is taken, in the field of hypotheses, as a paradigm. The content of the law is studied based on the theoretical-methodological basis of the Historical-Critical Theory, pedagogical current elaborated by professor Saviani, in his research assumptions, supported by historical and dialectical materialism and in his understanding of the rationale of school education: the teaching and learning of complex, elaborated, systematized knowledge. The study indicated that the expansion of the workload and the innovations of the curriculum, without a financing policy for public schools to implement these changes, especially when it comes to hiring, better remuneration and better working conditions for teachers, may be factors that take the school away from its social function.
