In this study, I discuss the difficulties of acknowledging human rights after the French Revolution of 1789, and in special, the right to attend a public school education. In the search for knowing the conditions for school inclusion, I examine the situation of school failure in the Brazil, as well as, recent changes implemented by public policies, in particular, the School Non-Retention Projects for Elementary Schooling. I came to the conclusion that still remains a great distance between what is legally proclaimed and what is really accomplished in terms of one’s right to education in Brazil.
