This article analyzes the Brazilian national panorama regarding the legalization of the democratic administration of education, in dialogue with article 14 of the Lei de Diretrizes e Bases da Educação Nacional (National Law of Education) (n. 9394/1996), and with article 9 of the Lei do Plano Nacional de Educação 2014-2024 (The National Education Plan Law) (n. 13005/2014). The text promoted a survey in the Legislative Houses websites, looking for legal pieces that deal with the matter. The analysis of the documents showed that only eleven states of the federation and the Federal District have their own laws of democratic administration. There is also a universe of other laws that deal with aspects of democratic administration, such as rules about school principals, school boards, among other topics. More important, however is the fact that the analysis of the material demonstrated a focus of legislation on administration of school units, with very few state laws dealing with the democratic administration of the school system.
