The aim of this paper was to analyze whether the quality of education can be demanded from the Tutelage Council (Conselho Tutelar). It is a qualitative research based on documents regarding the protective practice developed by the Tutelage Council for the effectiveness of educational quality. Data registered in the Information System for Children and Adolescents (Sistema de Informação para a Infância e Adolescência - SIPIA) regarding educational rights violated in Pernambuco, Brazil, were examined, which were treated in the light of the categorical analysis of content. The text was based on the debate held since 1990 on the quality of education, which coincides with the universal access to school, as well as with the social demands for the effective protection of children and adolescents. It was concluded that the lack of quality in terms of the practices carried out in the school routine represents a violation of educational rights enshrined in the Statute of Children and Adolescents (Estatuto da Criança e do Adolescente - ECA), even 30 years after its promulgation. Therefore, it is necessary to demand quality education in a social justice perspective, as this quality is still far from being achieved.
