This article addresses a problem of contradictory nature, experienced by state universities in Brazil: it is normally implied about these institution the condition of university and, simultaneously, they are denied to be institution of higher education (university). Based on the legislation, historical references and official documents, it appears that this contradiction prevents them access to public resources and promotes their exclusion from federal government policies (in general directed to the federal institutions of higher education, university or not). The paper considers the theme as the construction of the articulated national system of education in Brazil, being inevitable that society position itself either about the permanence of the state universities with university status to the integrated national system or about their transfer to the Union, integrating thus the federal system of higher education in the country. It should be emphasized that what is at stake with regard to access and permanence in public higher education, inclusive, university, is quality, and that only a stance in favor of this commitment provides some possibility of reversing the actual educational situation of limited access to higher education, deeply crystallized as a result of numerous mistakes and misunderstandings triggered in the past by a ruthless small and cluttered, policy.
