This article has as objective to analyze the process of elaboration of the law no. 5.303/2011, which creates the permanent cadre of teachers of religious education in municipal schools of the public school network in Rio de Janeiro. For this, a bibliographic review was carried out on religious education in public schools, survey and analysis of news articles in newspapers and magazines from 2008 to 2013, sessions of the Council of Municipal Councilors held from may to October in 2011 and legal documents - from 2008 to 2013 of the municipality of Rio de Janeiro regarding religious education - and interviews with agents from different educational instances of the municipality in question. The study points out the interference of the religious field in the educational field, through the ideological aspect through the creation of the permanent staff of religious teaching teachers in the municipal schools of the public school system of Rio de Janeiro, which is evident in the clashes surrounding the formation Required for teaching religious teaching and in the distribution of vacancies in the contest.
