This scientific article problematize the relation between the legislation that establishes the Guidelines of the secondary teaching in Brazil and the educational reality of this level of education. In doing so, and this is its goal, the article represents the idea that secondary teaching in Brazil, from a approach of the concept of field by Pierre Bourdieu, gathers the conditions to be studied as a subfield of the education. The starting point of the analysis is the Decree-Law 2/1837, that converted the Seminary of São Joaquim in school of secondary education, calling it Collegio de Pedro II, and, the point of arrival is the Law number 13.415/2017, that established changes in the current High School structure. In its conclusions the scientific article highlights that the refractive power of the secondary teaching, although arise from legislation that establishes its Guidelines, will be all the more direct the greater the participation of the subjects who work in this level of education.
