The study analyzes the current assessment public policy of brazilian higher education as an instrument of resistance to conservatism. It presents the environment of higher education in the country and explores aspects of the formulation, implementation and effects of Assessment National System of the Higher Education (SINAES). Elaborated as a connection between regulation and formative assessment, the System sustains itself as a resistance policy, if considering the formative and quality inducing characteristics present in some of its evaluation instruments. With theoretical-analytical character, the paper uses the dialogue between the literature and the documents about the thematic as hermeneutical resource. It concludes that SINAES, like other public policies, undergoes trough a dynamic process of changes, but remains relevant as a way of rethinking practices in higher education.
