Starting with a brief analysis of the process of creation of Brazilian universities and their significance in society, the article analyzes the functioning of the Special Commission nominated (in 1996) by the Ministry of Education. Its goal was to assess 38 processes for crating or recognizing universities sent for approval to the former Federal Counsel of Education. It calls attention to the pernicious aspects of the process, specially as regards criteria of merit and the role of the Ministry of Education.
