The statement of the Right to Education contained in Brazil's 1988 Constitution is much more detailed and broader than that found in the country’s former constitutions, including the stipulation of legal ways by which such rights can be legally enforced. This article analyzes such modifications and improvements, and attempts to examine whether if they have produced any practical effects. Twenty-two cases were seen where different aspects of such rights were in fact enforced in varying ways, including suits against the public administration. Such cases included action to require schools to admit students or to enroll students above the age considered ideal, or to desist from charging tuition in public schools or even to implement projects to reduce school dropout rates.
