Abstract

FISCHMANN, Roseli. Constituição brasileira, direitos humanos e educação. Rev. Bras. Educ. [online]. 2009, vol.14, n.40, pp.156-167. ISSN 1413-2478.

The 31st Annual Meeting of ANPEd celebrated the 20th Anniversary of the Brazilian Constitution, the 60th anniversary of the Universal Declaration of Human Rights, and their connections with education. As common points, these documents - one national and other international - were elaborated in moments of post-rupture, and both also gave a special role to education in the process of democratic reconstruction. The text seeks to reflect on this, taking the role of education in the internationalization and also in the internalization of human rights. The Brazilian Constitution of 1988 and complementary laws, like law n. 9.394/96, have important relations with the Universal Declaration of Human Rights and related international documents; however, it is not one-way track, the Brazilian Constitution was a result of processes and set in motion dynamics which profited from the accumulation of international juridical understanding and also the international system for the protection of human rights, and also ended up by influencing the international debate.
