This article has as object of study the education of human rights as a strategy to respect the rights of persons with disabilities. It refers to the historical construction of human rights, and the school's contribution to the realization of these rights now guaranteed by law. The school is a place to disseminate rights and to exercise a culture of rights, a privileged place for living together the human rights, a place to understand and experience diversity. Considering the implementation of the national education policy on human rights, a survey was carried out with 18 teachers and managers of basic education who work in schools that have included students, and questioned on their perception about the effectiveness of the current legislation that rules on the rights of persons with disabilities. The results evidences a discourse that includes the defense of the rights while demonstrating the frailty of the practice when related to the current legislation. To promote a change, the school needs to be educated on human rights and all the people involved in the educational process must collectively build projects that make the experience of human rights possible. Inclusive education as a guarantee of rights goes beyond being in school, it means contributing to equality of living conditions.
