This paper examines the educational politices initiatives related to higher education in Brazil, in 1995-1997. In the public sphere, two Projects are examined: the MARE Reform Project and the justification of MEC about the project of constitutional amendment regarding the university autonomy. In the private sphere, the ordinances 2.207/97 and 2.306/97 are analyzed concerning the distinction between the private and communitary institutions, as well as its identity implications. Comparying both spheres, the author concludes that, at least in a discourse level, the main demarcation would not pass in the division between the public and the private to delimit the specific difference between the excellence and the mediocrity.
