The text describes the process of construction of the new Brazilian evaluation system, sanctioned by law in the government of Luiz Inácio Lula da Silva - a system which implies a paradigm change in evaluation vis-á-vis mercadological regulation, in place since 1994. The new proposal of institutional evaluation, which respects the history and the previous evaluation experience of universities, is analyzed, along with the progression, regression and pressures suffered during the process which led to the sanctioning of the law by the president.
