After State Reform, in Brazil, in the 1990's, the execution of the public services was gradually transferred to the private initiative; in this model, the function of State is restricted to regulating the offer of these services. After 1996, in higher education, the LDB consolidated a close relationship between evaluation and regulation. In this historical context, this article analyzes the changes in functions of the national agencies that regulate and evaluate higher education. The research considers the main laws and decrees issued between 1995 to 2006. This article shows the implementation of a model of regulation, gradually, centered in the Ministry of Education and in the processes of evaluation, whose functions are executed by specialized agencies specially created or transformed for these propose.
