This article presents the results and the analysis of a qualitative research in education on the implementation of the nine-year Elementary School in the public schools of Diadema county. A study was carried out on the consequences of the federal laws nº 11.114/2005 and nº 11.274/2006 on the educational system in this city, throughout an empirical research carried out in an Elementary School and in an Early Education one, which had also classes for the first grade of elementary students. The data was collected throughout observations of everyday school life and interviews with those who were involved in the process. The data was analyzed in the light of the right to quality education and democratic management. The results indicate that there has not been an increasing offer in Early Education, that it is lacking an established curriculum for the first school year of the nine-year Elementary School yet and that there has been little participation of the professionals and the community in the discussion about this new configuration of the Basic Education.
