The aim of this research was to investigate whether the decisions for enrolling children who are not within the age required by Federal Constitution are granting the right to education in the Metropolitan Region of Campinas. In order to obtain a solution to the issue, a diagnosis was made using a quantitative methodology and identification of the attitude of public authorities by means of institutional analysis. It was found that the demands of the Office of the State Public Prosecutor for enrolling children under the age required is significant and it is always met by the judicial branch, which justifies the right based upon a broad interpretation that is not part of the Carta Magna. This attitude undermines the successful implementation of the policy by not respecting the boundaries stated in the legal texts, reducing the implementation of the rights of children of being admitted to school without discussing Human Rights.
