This article aims to discuss environmental education in the 21st century as approached by the Brazilian New High School Law. In the legislative change that occurred in 2017, we can see that the former curriculum components have been grouped by knowledge areas. Within this framework, we reviewed the role that environmental education will have in this new scenario, in which we observe the absence or weakening of that discipline. We tried to understand the reasons that led to the vacuum of public policies in environmental education occurring since 2012. This paper’s objective is to understand this absence and vacuum in the framework of a historical analysis of environmental education and education legislation in the 21st century. Our investigation was based on such sources as the New High School Law, the Common National Curriculum Base, besides other documents about environmental education, like the National Environmental Education Policy, the National Environmental Education Program, and national and international agreements on the subject. Also, as a basis for interpretation of the results we utilized some authors in environmental education or about environmental epistemology. The method used was documentary survey and qualitative review, having as a parameter of investigation environment and public policies. As to results, we expect to show the absence of new policies for environmental education, considering the educational challenges for the 21st century.
