Abstract

The purpose of this article is to discuss the current legal setting of Religious Teaching in the State of Rio de Janeiro, which is regulated by State Law No. 3459 of 14 September 2000. It is understood here that this Rio legislation does not meet the stated assumptions Federal Law No. 9475, 1997. To clarify this discussion, resort, at first, a theoretical discussion of certain concepts, including the "secularization", "secularism", "confessionalism", "active resistance", "plausibility structure" and "proselytizing" to try to understand how these concepts can contribute to understand the dynamics of the ER. Already a second time turns to the understanding of the legal and educational prerogatives involving the ER in its current configuration in the Brazilian public school and especially in the state of Rio de Janeiro. And in the midst of this perspective through the lens of historical analysis aims to understand the intricacies traveled by the ER in this state as an educational policy that currently enables the proselytism be present in the environment of Rio de Janeiro state schools.
