This article aims to understand the reasons that lead families to withdraw their children from school in order to adopt alternative forms of education, as well as to examine socio-legal arguments about homeschooling involved in the families’ right to choose alternative forms of education for their children. It is intended to explore the issues that permeate the subject, making it possible to deepen the theoretical and legal discussions. There are authors who defend the families’ right of choice, and others who warn against the risk of children not receiving formal education. Three families were interviewed, who carry out homeschooling for religious and health reasons. It is concluded that the manifestation of the Judiciary and the Legislative is necessary for this confusion to be solved, since families defend the possibility of choosing the education given to their children, while the State advocates compulsory schooling.
