This work analyzes the Bill no. 2401/2019 that proposes the regulation of Homeschooling in Brazil. The objective was to highlight the interests of the State in the regulation of the Individual Pedagogical Plan and its implications for the National Common Curricular Base and, consequently, for Brazilian society. In order to do that, dialogues with Lacerda (2019), Esteban (2010), Giddens (2012), Vasconcellos (2004), among others that contributed to support the arguments were established. It was concluded that the attempt to control school management and curriculum through neoconservative policies in Basic Education strongly threatens Education and the Democratic State of Law.
