This article aims to present an investigation into the actions of the State Education Councils of Southern Brazil during the COVID-19 pandemic and the influence of their normative acts on either reducing or deepening social and educational inequalities, as well as on ensuring the right to education. The investigative process was conducted through bibliographic and documentary research, guided by a review of the literature on the subject and an analysis of normative documents from these Councils, with a temporal focus on the COVID-19 pandemic period, from 2020 to 2022. The analyses indicate that the Councils sought to mitigate the negative impacts of the pandemic with the aim of ensuring access to education. However, their decisions reflected bureaucratic formalism which, by prioritizing the right to life, overlooked or downplayed the actual needs of the school community, thereby contributing to the worsening of inequalities.
