This paper reviews some aspects of the history of early childhood education in Brazil, from its beginnings, focusing particularly on the process through which it became a right for children and a duty of the State according to the Federal Constitution adopted in 1988. Drawing on Brazilian legal documents, especially constitutions, national education laws and other federal documents as well as others written by experts in the field of education, the study shows that, despite being legally recognized as a right, early childhood education has not been able to count on a network of institutions that may provide education to all children satisfactorily.
