This article presents considerations about the trajectory of Distance Education (DE) within the scope of public policies, programs and actions directed at Brazilian education in the last 40 years. In this way, the historical evolution of the modality and its implications for the democratization of education in Brazil are discussed in a chronological way, based on the observation of legislation and publications on the subject. The main objective of the paper is to introduce the main initiatives that enabled the Brazilian Distance Education, as well as its current situation. For the investigative process, a bibliographical and documentary research was carried out around the evolution of DE between the years 1978 and 2018, with emphasis on milestones considered essential in the process, such as the publication of the Law of Guidelines and Bases of Education (LGB) No. 9394 of 1996, Decree No. 5622 of 2005 and Decree No. 0957 of 2017, among other documents, which greatly influenced the current configuration of Distance Education. As a conclusion, it was noticed that, despite many advances, there are obstacles that hamper its institutionalization, especially regarding the regulation, quality, and control by the State.
