This paper addresses aspects related to the role of federated entities, considering the federative model of organization of Brazilian Education, the process of municipalization of the Basic Education, the decentralization of the educational policies, the collaborative regime in the implementation of policies in the scope of Early Childhood Education. The aim is to highlight challenges in the post-2016 context in the field of research in educational policies and the effects on local policies to be implemented. Such aspects originate from studies that deal with the collaborative regime between educational systems, from the analysis of decentralization and municipalization of education, from educational data regarding the right to access to Early Childhood Education, mandatory at 4 (four) years of age enrollment instituted by Constitutional Amendment 59/2009 and the challenges imposed by the conjuncture for the fulfillment of this constitutional precept. The analyzes were carried out via bibliographic research of the production of the specific field and documentary analysis and educational data on elements that influence the realization of the right to access early childhood education, considering the government initiatives that represent setbacks compared to the legally declared to guarantee the right to education. Results of these analyzes show that such initiatives are contrary to the policies developed over the last decades and to what EC 59/2009 and the PNE 2014-2024 foresee in expanding access to Early Childhood Education and overcoming educational inequalities.
