The guarantee of vacancies in nursery schools in the municipal public system is a right of every child and an increasing social need, however its implementation has been a challenge for the municipalities, given the recurrent observation of waiting lists for vacancies in this stage of schooling. This article, results of a research of documentary basis and exploratory type, with updated data, analyzes the educational policy indicators of the municipality of São José do Rio Preto-SP for its vacancies availability in nursery schools in its public system in the period of 2010 to 2019, highlighting its expressive demand and the actions developed in order to reset the waiting lists. The results indicate that, even with a planning based on official data and with the accomplishment of a significant set of actions that increased the offer of vacancies, the registered number on the waiting lists in 2019 exceeds the number observed in 2010, given the observed increase in demand. Variables such as urban mobility between municipalities and the different growth rates by region within the municipality directly impact on the planning of these actions and consequently on the fulfillment of this legal determination, which implies the need for joint action between the different Secretariats and departments of public municipal administration.
