This article aimed to apprehend the conceptions of educational policies presented by the main standardization that governs education both in Brazil and Paraguay. Therefore, we sought to elucidate the following guiding question: what conception of management do the 1996 Law of Guidelines and Basis for National Education in Brazil and the 1998 General Education Law in Paraguay present? The research was developed through a qualitative approach, with bibliographic and documental research, having as main sources the LDB/1996 and the LGE/1998. Throughout the discussion, and based on the educational literature, we concluded that the conception of management presented in the legislation of educational policies in Brazil and Paraguay can be understood as hybrid, since it emphasizes the democratic management and participation, however, it tackles several characteristics of managerial management as if they were signs of democratic management. In this way, managerial management has been taken on not only in private initiatives within the scope of public management, but also in Latin American societies since the educational reforms, legitimized in legal spaces. It should be noted that there is a setback in putting into effect the participation and the democratic management, especially regarding the mechanisms for its effectiveness and the influence of international guidelines on the educational policies in these countries.
