This study aims to examine the legal feasibility of requiring in court the right to quality basic education, when this right, which should be provided by competent agencies (Executive Branch), is violated, disrespected and/or not effected. The methodology employed is the literature research with emphasis on the legal and educational areas, analyzing from books, to journals, documents and laws. The theoretical framework includes Romualdo Portela de Oliveira, Gilda Cardoso de Araújo, Sergio Haddad and Carlos Roberto Jamil Cury. This research has therefore as its major result some legal means capable of ensuring the quality of basic education. The discussion of the possibility of this demand is based on the analysis of three dimensions of educational quality: input, process and results. This research was fostered by CAPES.
